ACT 44 ANNUAL DISCLOSURE STATEMENT


PUBLIC NOTICE

          NOTICE IS HEREBY GIVEN that the Borough Council of the Borough of Downingtown will conduct a public hearing at its regularly scheduled meeting at 7:00 PM on October 4, 2017, at the Municipal Government Center, located at 4 West Lancaster Avenue, Downingtown, PA, 19335, to consider the criteria established under the Local Economic Revitalization Tax Assistance Act (“LERTA”) for determining the boundaries of identified “Deteriorated Areas” as defined therein, and to consider enactment of an Ordinance adopting a tax exemption for improvements and construction within those deteriorated areas depicted by attached plan.  The Ordinance to be considered is described as follows:

AN ORDINANCE OF THE BOROUGH OF DOWNINGTOWN ADOPTING THE LOCAL ECONOMIC REVITALIZATION TAX ASSISTANCE PROGRAM FOR TAX EXEMPTIONS WITHIN THE BOROUGH OF DOWNINGTOWN; PROVIDING FOR A TAX EXEMPTION AMOUNT AND EXEMPTION SCHEDULE; AND ESTABLISHJING PROCEDURES TO OBTAIN SUCH EXEMPTION

Section 1 provides definitions for the following terms: LERTA or ACT, ASSESSED VALUATION, BOROUGH, COUNCIL, DETERIORATED AREA, DETERIORATED PROPERTY, IMPROVEMENT, LOCAL TAXING AUTHORITY.

Section 2 provides for a property tax exemption for deteriorated properties identified in a proposed resolution.

Section 3 sets forth the areas eligible for tax exemption.

Section 4 sets forth conditions upon which the tax exemption will be granted.

Section 5 identifies the exemption schedule for the tax exemption.

Section 6 sets forth the procedure for obtaining a tax exemption under the Ordinance.

Section 7 sets forth the termination date for the tax exemption.

Sections 8, 9, and 10 address issues of applicability, severability, and effective date

An opportunity will be afforded to all interested persons in attendance to address Borough Council in the matter of this Ordinance. The full text of the Ordinance and a plan depicting the proposed area are on file at the Borough Hall, located at 4-10 West Lancaster Avenue, Downingtown, PA, 19335, where it can be viewed by members of the public during normal business hours, or copied for a charge not greater than the cost thereof.  Or click here to download. REMINDER TO RESIDENTS: Current residential parking permits expire on September 30, 2017.  New permits are now available at Borough Hall.   Applications must be submitted in person with proof of residency. Only designated streets/addresses are eligible for these permits.
