LEGAL NOTICE

NOTICE IS HEREBY GIVEN that on July 11, 2018, the Borough Council of the Borough of Downingtown, Chester County, Pennsylvania, (the “Borough”) enacted an Ordinance which, among other things, authorized the incurring of lease rental debt (and the exclusion of such debt as self-liquidating) in the stated principal amount of $5,525,000 to be evidenced by a Guaranty by the Borough of $5,525,000 principal amount of the Downingtown Municipal Water Authority’s Guaranteed Water Revenue Note, Series of 2018 (the “Note”). A summary of the Ordinance was advertised on July 5, 2018 and the proposed text has been available for examination at the office of the undersigned. The range of lease rental payments is from $114,678.39 to $909,753.53. No amendments or insertions were made to the Ordinance on final enactment. A complete text of the Ordinance as finally enacted may be examined by any citizen of the Borough, in the office of the Secretary of the Borough, at the Downingtown Municipal Government Center, 4-10 West Lancaster Avenue, Downingtown, Pennsylvania, Monday through Friday from 8:30 a.m. to 4:30 p.m., prevailing time.

PUBLIC NOTICE

 

            Notice is given that the Borough of Downingtown will hold a public hearing to consider the enactment of the following ordinance amending the Code of the Borough of Downingtown, at its regularly scheduled meeting at 7:00 PM on August 1, 2018, at the Downingtown Borough Hall located at 4 W. Lancaster Avenue, Downingtown, Pennsylvania. The proposed ordinance is summarized as follows: 

 

AN ORDINANCE OF THE BOROUGH OF DOWNINGTOWN, CHESTER COUNTY, PENNSYLVANIA, AMENDING THE ORDINANCE OF THE BOROUGH OF DOWNINGTOWN, CHAPTER 287 ENTITLED “ZONING”, ARTICLE V ENTITLED “R-1 SINGLE-FAMILY DETACHED RESIDENTIAL DISTRICT”, AS AMENDED, BY AMENDING SECTION 287-20 (ENTITLED “AREA AND BULK REGULATIONS”) BY ADDING NEW SUBSECTION J THERETO PROVIDING SPECIFIC AREA AND BULK REGULATIONS FOR USES PERMITTED BY SPECIAL EXCEPTION IN SECTION 287-19.C.

 

Section 1 amends §287-20 of the Zoning Ordinance by adding a new subsection “J”, which sets forth the following requirements for special exception uses permitted under §287-19.C: Maximum Building Coverage of 35%; Maximum Total Impervious Surface Coverage of 70%; Minimum Front Yard of 25 feet; Maximum Building Height of 50 feet.

 

Sections 2, 3, and 4 address issues of severability, repeal, and the ordinance’s effective date.

The proposed ordinance contains an ending clause indicating the date of enactment and signature lines for the Borough of Downingtown Borough Council, Mayor and Borough Manager/Secretary.   

An opportunity will be afforded to all interested persons in attendance to address the Borough of Downingtown in the matter of this ordinance. A full text copy the Ordinance is available for public inspection, and/or copies of the Ordinance can be obtained for a fee, at the Downingtown Borough Hall at the address listed above during regular business hours, 8:30 AM to 4:30 PM Monday through Friday (except holidays).

ACT 44 ANNUAL DISCLOSURE STATEMENT

ZONING HEARING BOARD NOTICES (1)

NOTICE

The Zoning Hearing Board of the Borough of Downingtown, Chester County, PA, will meet on Tuesday, August 21, 2018, at 7:30 p.m. at Borough Hall, 4 West Lancaster Avenue to consider:

Application ZHB 2018-003: Downingtown Area School District for special exception and variance relief for property located at 335-445 Manor Avenue, Borough of Downingtown, having approximately 33.77 net acres located within the R-1 Single-Family Detached Residential District, and further identified as UPI Nos. 39-2-44 and 11-3-7. The following relief has been requested in order to expand the existing Downingtown School District S.T.E.M. Academy campus and parking facilities: (a) special exception pursuant to §287-19.C.(2) to permit an educational use within the R-1 Zoning District; (b) special exception pursuant to §287-82.B. for an alternative lighting system and standards for the parking area; (c) variance pursuant to §287-78.B.(3)(b) to permit construction of parking area without intervening planting areas of at least 75 square feet for every 12 parking placed in a continuous row; (d) variance pursuant to §287-78.B.(3)(a)[1] and [2] to permit perimeter planting along only a portion of the perimeter of a parking area exceeding 20,000 square feet; (e) variance pursuant to §287-78.D.(4), Table 1 (Minimum Planting Guidelines) to permit planting within the perimeter of the proposed parking area that is less than required; and (f) variance, in the alternative to special exception, pursuant to §287-82.A.(2) to permit lighting fixtures within the proposed parking area exceeding 16 feet in height.
